At the forefront of both the President’s and the Senates’ agendas this term is the issue of what to do with the “employed illegal immigrants” in the country. This issue is being debated and new legislation has been proposed.   An important part of the proposed legislation is increased enforcement of employer sanctions.  This will most likely not have any impact on the I-9 process, but more likely will mean more stringent enforcement measure being taken against employers for knowingly hiring illegal employees and audits of employers’ Form I-9’s.

The U.S. Department of Homeland Security Immigration Customs and Enforcement (ICE) continue to issue Form I-9 Notices of Inspection to businesses across the nation.  With New Jersey being having one of the largest immigrant populations in the nation, it is not surprising that New Jersey also produces the greatest amount of penalties after a Form I-9 inspection.

In order to avoid costly penalties and assure compliance with Form I-9 obligations, it is crucial that employer’s perform a self audit of their Form I-9’s.

This program will cover a detailed overview of the Form I-9; how to properly fill out the I-9; IRCA; ICE Investigations and current worksite enforcement policy; ICE IMAGE program and other practical tips for employers to avoid costly mistakes.
