I-9’s, Audits and Enforcements

In 2009, the Secretary of Homeland Sectary, Janet Napolitano implemented a new comprehensive strategy for reducing the number of unauthorized employees in the workplace.  Where previously, the focus was on seeking out unauthorized employees, through raids and other workforce enforcement actions, the current strategy is to reduce the demand for illegal employment by the prosecution of employers for knowingly violating immigration laws.  The enforcement arm of the Department of Homeland Security, Immigration and Custom Enforcement (ICE) has stated that greater resources will be directed on investigating and auditing employer Form I-9 compliance.  As recent as September 28, 2010, a major retailer reached a settlement over $1,000,000, as a result of a Form I-9 inspection by ICE. This settlement was a result of an audit which covered stores located in only one state and where there were no instances of knowing hire of unauthorized aliens.

Because there is an increase chance of being audited by ICE, it is crucial that employer’s perform a self audit of their Form I-9’s to ensure compliance with recordkeeping requirements and to avoid costly penalties. 

This program will cover all aspects of Form I-9 Compliance, including, IRCA and an overview of Employment Verification Procedures, Social Security No Match, Avoiding Discrimination related to citizenship and national origin, CIS' E-Verify Program and practical tips for employers to avoid costly mistakes.  A special guest speaker, Alan Janda, from ICE will be presenting on I-9 Audits and Government Investigations.
