Labor Law for Non-Union Employers

The National Labor Relations Act (NLRA) guarantees the right of employees (not supervisors) to collectively bargain with their employers and to engage in other protected, concerted activity.  Employers engage in unfair labor practices when they interfere or restrain the exercise of these rights through unfair discipline, threats of discharge or other adverse actions. Workplace policies can also violate the NLRA when they are overboard or  unduly restrictive.  This seminar will provide a straight forward,  in-depth understanding of how the NLRA applies to non-union employers, including:

  • The legal distinction between “employees” and supervisors;
  • Union-fee policies and statements;
  • Non-solicitation and distribution policies and practices;
  • Free speech, surveillance and social networking;
  • Unfair labor practices, including discipline;
  • Harassment;
  • Moonlighting and Fraternization;
  • Discussion of wages, benefits and other conditions of employment;
  • Dress Codes; and
  • Employer-dominated meetings.
