**Special HR Alert - New Jersey Overhauls Wage and Hour Rules**

The New Jersey Department of Labor and Workforce Development has repealed its existing rules regarding exemptions from overtime for bona fide executive, administrative, professional and outside sales employees and replaced them with the analogous federal overtime exemption regulations – the so called “541 exemptions.”

The New Jersey overtime regulations were originally modeled after the federal regulations, however, when the federal regulations were amended in 2004, NJ took no action thereby leaving employers in the State to juggle two sets of rules.

The amended regulations, which are effective immediately, adopt by reference the entirety of 29 CFR Part 541, which would include not only the duties test, but also the salary basis test, safe-harbor provisions, highly compensated employee rules and more
