Unlike the federal Age Discrimination and Employment Act (ADEA), the N.J. Law Against Discrimination (LAD) permits employers to “refuse to accept for employment”  However, on June 1, 2010 the Supreme Court of New Jersey decided Nini v. Mercer County Community College, which held that an employee can bring suit under the N.J. Law Against Discrimination (LAD) alleging age discrimination in connection with the nonrenewal of an annual contract. The decision breaks new legal ground and exposes employers to age discrimination liability by treating the nonrenewal  of a contract like a termination.  Other issues abound.  Under federal law, the aggrieved employee must show that he or she was replaced by a “substantially younger” worker.  Not the case under New Jersey. This one-hour Webinar will dissect the Nini decision and clarify the differences between federal and state age discrimination law.
