How to implement the USDOL's NEW Exemption Criteria

The USDOL has published final regulations re-defining the criteria necessary to qualify as an exempt employee under the Fair Labor Standards Act. The salary threshold will be increasing from $23,660 to $47,476 per year (or from $455 to $913 per week). Additionally, this salary level is set to increase every 3 years. The DOL estimates that in the first year of implementation, over 4.2 million workers will gain access to overtime nationwide, 130,000 in NJ alone.

The new rules are effective December 1, 2016.
