The use of communication technologies has exploded at work.  While the Internet has become indispensable in today's workplace - 90 million United States workers send over one billion e-mail messages a day - newer technologies, such as instant messaging,  have also created new and perplexing legal issues for employers.  EANJ has kept its members informed over the last decade on the legal issues that have arisen from the Internet, email, instant messaging, social networking and other electronic media at work.  It’s now clear that a critical mass of cases spread over various federal and state laws have created a sub-section of HR law dealing with these cutting edge issues.  This live 3-hour seminar led by John Sarno, Esq. will provide an up-to-date summary of this important and evolving area of HR law.  Partial list of cases that will be covered:

  • City of Ontario v. Quon: “Sexting” at work.
  • Roe v. City of San Diego: Off duty Internet porn.
  • Smyth v. Pillsbury: Discharging employee over hostile email.
  • Blakey v. Continental Airways: Internet harassment
  • Fraser v. Nationwide Mutual Insurance Company: Reading stored emails.
  • Galante v. Board of Review, Department of Labor and Foxtons, Inc : Ineligibility for unemployment because of Internet misuse.
