Depends on who is asking.  There are at least five different tests for determining independent contractor status used by different government agencies and the courts.  In July 2015 the USDOL issued a new Administrator’s Interpretation concluding that “most workers are employees under the Fair Labor Standards Act.”  Further, in early 2015, the NJ Supreme Court issued a decision regarding the proper test to use when determining employee status under NJ Wage Hour Law.  As government agencies renew their efforts and increase enforcement of misclassified workers, it is more important than ever for employers to get the classification right.
