The Equal Employment Opportunity Commission (EEOC) has issued final rules implementing the Genetic Information Nondiscrimination Act (GINA). GINA applies to employers with 15 or more employees. The final rules make clear that employer requests for medical information under the Family Medical Leave Act (FMLA), the Americans with Disabilities Act (ADA) and other policies will require revisions.
Title II of GINA explains the prohibitions on acquiring and using genetic and other health-related information in employment. They also define genetic information, provide model language for employers to use when requesting medical information, and detail narrow exceptions to the prohibitions of the law. This Webinar will provide an overview by two of EANJ?s senior staff and will cover:
- What is "Genetic Information?"
- How an employer acquires genetic information
- FMLA considerations
- ADA considerations
- HIPAA Privacy - Employee Wellness Programs
- Confidentiality and record keeping
- Penalties for non-compliance
- "Slaying the Dragon"
