The Lilly Ledbetter Fair Pay Act, enacted in January, 2009, poses practical problems for employers and puts the onus squarely on the performance evaluation process. The law's reference to compensation and “other practices” clearly encompasses performance appraisals when they led to pay or promotion decisions. Further, since each paycheck is considered a distinct act of discrimination, employees will be entitled to argue that each performance appraisal, even old ones, contributed to the unequal pay.
