The Lilly Ledbetter Fair Pay Act, enacted in January, 2009, poses practical problems for employers and puts the onus squarely on the performance evaluation process. The law's reference to compensation and “other practices” clearly encompasses performance appraisals when they led to pay or promotion decisions. Further, since each paycheck is considered a distinct act of discrimination, employees will be entitled to argue that each performance appraisal, even old ones, contributed to the unequal pay.  More than ever, employers must take steps to ensure that supervisors are skilled in implementing performance appraisals.  This Webinar will cover:

  • What is “unequal pay?”
  • Overview of Fair Pay Act
  • A critique of the performance appraisal process
  • Review of relevant case law
  • The case for supervisory training
