Setting Female Employees Up for Failure Constitutes Job Discrimination

The Third Circuit Court of Appeals held that female sales representatives, who were discharged for failure to meet sales quotas, raised factual issue as to whether their employer's reason for their discharges was an excuse for sex discrimination, even though they were not meeting their sales quotas.  The court found that a jury could determine that the women were set up for failure when they were assigned less desirable sales territories and denied same training opportunities as male representatives.  There was also evidence that sales quotas were enforced more harshly against the women than they were against males. 

The case of Grassmyer v. Shred-It USA Inc., decided in September, 2010, may substantially change how male managers evaluate job performance of female employees.
