In New Jersey, a worker’s status is premised on the presumption that a worker is an employee, unless the employer can prove otherwise by demonstrating that a worker qualifies as a contractor under NJ’s three-pronged ABC test.  The ABC test has long been used by NJ’s Department of Labor and Workforce Development and recent decisions by the Third Circuit Court of Appeals and the NJ Supreme Court highlight the importance for employers to properly classify workers.  Additionally, the US Department of Labor has just issued a proposed rule to clarify who is an Independent Contractor under the Fair Labor Standards Act.  Join us for  this timely one-hour webinar focusing on what you need to know to stay compliant and avoid costly violations.
