A recent amendment to the Temporary Disability Benefits (TDB) law requires all New Jersey employers, both public and private, to post notice as to whether or not they are covered under the TDB law and to inform employees that pregnancy is covered as a disability.

A revised poster (PR-1) is available for employers who are covered under the TDB law.  For public employers not covered under the TDB law, a new poster (PR-1B) should be posted stating that the employer is not subject to the law.

Additionally, covered employers have the responsibility to notify an employee of his/her rights upon the occurrence of a disability and employers who use the State Plan (as opposed to an approved Private Plan) must provide a claim form to the individual by the ninth day of disability.
