The National Labor Relations Board (NLRB) has reversed its prior decision that non unionized employees are entitled to assistance of a co-worker during an investigatory interview which the employee reasonably believes will lead to disciplinary action. The so called Weingarten Rule will continue to apply to employees in a union environment.
