The United States Citizenship and Immigration Service (USCIS) is amending it’s regulation with regard to acceptable documents and receipts that can be utilized to complete the Form I-9, Employment Eligibility Verification.   The amendment which will be effective February 2, 2009 provides that expired documents will no longer be acceptable for the Form I-9 verification process, including expired U.S. passport or passport card.  These changes are being made to ensure that “acceptable documents reliably establish identity and employment authorization”.  Additional changes have been made to the list of acceptable documents, as well as, changes have been made to the Instructions for the Form I-9.

Employers must use the revised Form I-9 for all new hires and to reverify any employee with expiring employment authorization beginning on February 2, 2009.  A new Form I-9 is available to download  at the USCIS website and Handbook for Employers, Instructions for Completing the Form I-9 (M-274) should be available for download from the USCIS website prior to the effective date.
